Terms & Conditions
By purchasing from Hardscape Direct LLC (“Seller”), the customer (“Buyer”) agrees to the following terms and conditions:
1. LOADING & TRANSPORT Buyer assumes full responsibility when permitting Seller to load Buyer’s vehicle. All materials must be properly tarped and secured prior to departure. Seller shall not be responsible for damage, loss, shortages, or overages once materials leave the premises. Buyer is responsible for verifying all quantities and measurements prior to purchase.
2. PAYMENT TERMS A 3% processing fee shall apply to all credit card transactions. All equipment purchases must be paid in full prior to shipment. Refunds on purchases made by check shall be subject to a ten (10) day holding period.
3. RETURNS & RESTOCKING All returns must be accompanied by the original sales receipt and are subject to prior approval by Seller. Approved returns may be subject to a restocking fee of up to twenty-five percent (25%). Returns are accepted within thirty (30) days of purchase unless otherwise stated. Pallet deposits are refundable within ninety (90) days.
4. NON-RETURNABLE ITEMS The following items are non-returnable: special order products, equipment, sealers, cleaners, chemicals, lights, bulk or base materials, natural stone, and any materials not returned in original condition. Brick returns will only be accepted in full pallets or bundles.
5. PALLETS & PRICING Pallets are subject to deposit. All prices are subject to change without notice.
6. WARRANTY DISCLAIMER All equipment is sold “AS IS” and without warranties of any kind, whether express or implied. Seller warrants only that products conform to the description on the applicable label. Seller makes no other warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. If the original equipment manufacturer offers a warranty, Seller will pass through to Buyer any transferable product and equipment warranties, indemnities, and remedies provided to Seller by the manufacturer.
7. LIMITATION OF LIABILITY Buyer acknowledges that conditions of use are beyond Seller’s control. Seller shall not be liable for any damages arising from the use or handling of its products. Buyer assumes all risk associated with the use, storage, and handling of all products, whether or not such use is in accordance with provided instructions.
8. ACCEPTANCE OF TERMS By completing a purchase, Buyer acknowledges and agrees to all terms and conditions stated herein.
